Music Publishers Sue YouTube

In September 2006, the same group won a judgment against a peer-to-peer filing service, StreamCast Networks.

The National Music Publishers' Association this week joined a class action lawsuit alleging that YouTube and its parent company Google have committed massive copyright infringement.

The group announced Monday that it is rallying along with the Football Association Premier League Limited and others in the suit filed in the U.S. District Court for the Southern District of New York.

"Copyrighted music is a huge draw for YouTube's users," the NMPA said in a prepared statement. "This music can be found in many of YouTube's clips, in both pre-existing commercial content and videos."

A spokesperson with Google was surprised and disappointed that the NMPA has elected to take this route.

"We have concluded historic licensing agreements with several NMPA members and have been in licensing discussions with others," Google Managing Litigation Counsel, Michael Kwun said. "Many song writers and music publishers view YouTube as a promising promotional platform for connecting with their fans and as a unique revenue opportunity. "

NMPA President and CEO David M. Israelite said the group is "very concerned about YouTube's approach to copyright."

"We are joining the lawsuit to protect the interests of music publishers and songwriters, whose creative works are being used without permission or compensation by YouTube, he said."

The NMPA is a music publishing industry trade association promotes and advances the interests of music publishers and their songwriting partners, while fostering a business creative and financial growth for more than 600 members. It was established in 1917, and is active globally in terms of protecting copyrights.

In September 2006, the group won a judgment against a peer-to-peer filing service, StreamCast Networks.

The Football Association Premier League, a British soccer division with an estimated 2.6 billion spectators, filed the lawsuit against YouTube in May. The lawsuit is one of many that Google and YouTube are currently defending.

Facebook, social capitalists and open networks

As the stock market roller coaster continues, the concept of social capital accrued via social networks is starting to become an important commodity. People are flocking to Facebook and other social networks, partly to experience the latest online trend and for those who latch on to a particular network, to build up their social capital via making connections.

Facebook co-founder Dustin Moskovitz has said that Facebook’s main professional value is “building social capital” through interactions, including email via Facebook, with ‘friends’ that can result lead to business opportunities. Dennis Howlett has covered the social network and business intersection issues in his Irregular Enteprise blog. It’s early in the game, but it’s not hard to imagine how Facebook could adopt some of LinkedIn’s features, or vice versa.

Much of the discussion lately touches on that fact that the development of one’s social capital is contingent it being locked up by Facebook. LinkedIn or other social ‘utilties.’ services.

In a recent Wired article, Scott Gilbertson, protested the lack openness in Facebook, namely the social graph, the circle of friends and relationships data.

When entering data into Facebook, you’re sending it on a one-way trip. Want to show somebody a video or a picture you posted to your profile? Unless they also have an account, they can’t see it. Your pictures, videos and everything else is stranded in a walled garden, cut off from the rest of the web.

Like locked cell phones and copy-protected music, Facebook is on the wrong side of the open-network debate. Facebook is a sealed bubble. Facebook users are locked into Facebook, just as iTunes locks music fans to Apple’s iPod.

“We are pushing boundaries of what closed and open mean. It’s very necessary for people to take identities with them and supplement with content from elsewhere,” Moskovitz said at the AlwaysOn Stanford Summit 07 last week. He didn’t offer any insight as to what Facebook has in mind regarding making the friends network, the social graph, transportable beyond exposing it to Facebook-compliant applications.

“I’m not sure if it will happen or not. It’s fairly complicated and there are privacy issues, but interesting concept,” said MySpace’s Travis Katz, senior vice president and general manager of MySpace International, regarding making its data transportable.

Plaxo recently launched its Pulse service that is more permeable. Your friends network can be walled off. Anything put into Plaxo can be retrieved and used elsewhere, and any data made public will be accessible across the wider internet: Viewers will not need a Plaxo account. The service will be rather limited initially, but it’s a step in the right direction.

Wired is actually late to the open network discussion, which has been brewing for more than year, led by Marc Canter. In his latest post, Marc wrote:

History will prove that by freeing the end-user’s data, a distributed mesh of inter-connecting social networks and blogging platforms will create an ecosystem in which ALL software vendors and plaforms can participate in- equally.

That’s what’s wrong with MyBlogLog, Twitter and Facebook. They’re coolio platforms, but they’re closed.

The people will eventually come. That’s for sure. Humans are migratory beasts and as soon as they figure out that they’ve been locked-in-they’ll rebel.

At this point, the masses haven’t taken to the virtual streets to break down the walled gardens. The information superhighway is broken up into islands where millions of people gather and associate, separated from other islands by design.

Today, people are mostly content, experimenting with the more civilized walled gardens that aggregate information and friends and bank all the personal data and social capital. The revolution won’t happen until social capitalists realize that the capitalists–Facebook, Google, MySpace (News Corp.), etc.– shouldn’t have too much control over their digital lives.

Recruiters scour social networking sites - Indian Overview

Orkut, Linkin, Facebook and other similar popular social networking sites are fast doubling up as the modern day employment exchanges with job seekers as well as companies and recruiters head hunting for talent.

The social networking sites, immensely popular with the netizens, especially the young, are having number of ‘communities’ helping both job seekers and employers.

“Searching for the right person for a job is always a challenge,” says Gauri Sarin of Approach Talent Solutions. “So, there is a rising trend among the companies and recruitment agencies to use social networking sites to look for the right person,” she adds.

With 100 million Internet users in the country, India is now the fourth largest country in terms of Internet penetration, a recent Assocham study points out.

According to Assocham, E-recruitment is gaining ground as a preferred medium of hiring in India. Especially for job seekers, the Internet has opened up the world of job searching, turning it into a 24-hour-a day market place. Internet is arguably the most immediate, convenient and comprehensive medium for employment seekers to research for jobs.

While searching for ‘jobs', communities like Orkut throw up about a 1,000 odd related communities such as 'IT jobs India walk-ins','Freshers','Retail Jobs in India', 'Walk in for Jobs', Job Sampark' etc.

Staffing services providers like Cloud 9 India, Pathway Recruitment Agency use such sites as a platform to hire. They have links to their own websites.

Populated with thousands of members each of these communities have a huge database of job seekers and can reach them within seconds. “Of all new services on the Internet, social networking sites are most promising because these community-driven sites have the ability to leverage their user base across other verticals,” says R Sunder, president, Times Business Solutions.

He adds, “Most of the growth in the social networking space has happened in the last one year. It will continue to accelerate as more people gain high-speed Internet access. It has come down to mobile phones and with web 2.0 coming to market, the future seems to be limited only by the imagination.”

Young people are making most of it. Says Neha Kapoor, a fresh graduate from Kanpur, “I got a job in one of the best BPOs in Delhi thanks to a ‘scrap’,” a term used by Orkut to describe the messages that are posted on the net.

B Sudhir, software engineer, 25, moderator of a community ‘Walk in for Jobs’ in Orkut says, “I started this community as a hobby. Having gone through the hardships of finding a job, I wanted to create a platform for freshers.”

His community claims to have membership of over 30,000 members. Sudhir says, “Other than the recruitment agencies, many corporate houses directly post their requirements on the site.”

He also has a blog whose members receive job opening postings in their mail boxes. Although most of these services are free yet there are ways to monitise these communities by dividing the jobs into free and paid categories, in which the recruiter pays for some specific advertisements.

There are many networking sites other than Orkut such as Facebook, Myspace,Yaari among other popular professional networking sites like Linkin, Ecademy, Doostang, Xing, Plaxo, et al.



Linkin, a business oriented social networking site, is mainly used for professional networking, with a membership base of 12 million across 400 economic zones it is very popular in the US. Linkin allows regular users to maintain list of contact details of people they know and trust in business. It is now fast catching up in India.

“Such sites cater to those who require fresh blood like BPO’s and especially IT industry. While Linkin is effective for the senior levels,” says Sarin.

According to Assocham survey, junior,mid-level and senior executives accounted for more than 50 per cent of the online job seekers.

Also 46 per cent of the online job seekers fall between 26 to 35 age group. Thus with an estimated 120 million Indians logging on to the net in 2007-08, head hunting through networking sites is a trend that will only increase.

“While social networking is one of the current mainstream media buzzwords, in the recruitment and staffing space it is all about helping employers to find and match candidates to open job positions and build a talent pool. Whether social networking is the answer to recruitment is yet to be seen,"says Sunder.

Social networking sites enjoy massive visitor surge

Online measurement firm comScore has released a report detailing the dramatic rise of social networking sites.

Sites such as Facebook and MySpace are increasingly taking internet advertising share from Yahoo and other market leaders, and the new study shows that these established giants may truly have something to fear.

MySpace received 114 million unique visitors in June 2007, an increase of 72 per cent compared to the 66 million who visited during June last year.

Facebook performed even better, attracting 52 million unique visitors, which was a 270 per cent increase on the 14 million who logged in during June 2006.

Other sites performing well included Hi5, Friendster, Orkut, Bebo and Tagged. The latter logged a whopping 774 per cent increase in visitors, while Bebo's numbers grew by 172 per cent.

"During the past year, social networking has really taken off globally," said comScore's Bob Ivins.

"Literally hundreds of millions of people around the world are visiting social networking sites each month and many are doing so on a daily basis. It would appear that social networking is not a fad but rather an activity that is being woven into the very fabric of the global internet."

Flickr Rises As Yahoo Photos Departs

Shutting down Yahoo Photos in favor of the popular Flickr service has helped lift Flickr's market share of photography traffic.

While Photobucket commands the photography category with 43.5 percent of the market, Flickr's 6.42 percent of visits measured by
Hitwise for the week ending July 7 proved good enough for second place.
Hitwise research director LeeAnn Prescott said Flickr's US market share grew by 38 percent in the four weeks leading up to July 7. In June, Yahoo began encouraging its Yahoo Photos users to migrate over to Flickr.

Prescott also noted how Flickr's traffic has shifted. Where Google once represented Flickr's largest source of traffic, Yahoo Image Search has taken over that place. Yahoo Image Search now accounts for almost 18 percent of Flickr's traffic.

The consolidation of image services has worked out for Yahoo, both in the US and internationally. We will be interested to see if Yahoo continues to trim its duplicate services under new CEO Jerry Yang.

Piczo Launches Piczo Insiders


San Francisco-based social network Piczo will announce the launch on Tuesday of Piczo Insiders, a focus group of influential users who will advise brands on how to leverage the site. Certain marketing campaigns on the site will be passed to the Insiders for feedback, something that already happened with the latest NSPCC (National Society for the Prevention of Cruelty to Children) campaign.

Piczo is claiming 28 million registered user accounts and 12.5 million monthly unique visitors generating over 1.9 billion monthly page views. Last time we checked, the demographic was predominately female and many users were in the UK.

It’s intriguing that they’re roping in the users for feedback on campaigns, but ultimately
Piczo may now need to ramp up on the consumer side to stay relevant.

ZoomInfo: a search engine index of company names and people. Find yourself (if you are there) and claim your space or create your profile.

Spoke: a database of contact information for people at all levels of business.

Jigsaw: a database of virtual business cards that can be traded and shared amongst members.Associated Marketing StrategyCreate a personal profile on each of these sites and connect, connect, connect. The concept is so simple I could almost stop there but it is important not to forget that some of these services also allow for interactivity in forums and Q&A sections. I recommend participating as often as possible in these interactive sections in order to gain positive references and to further expand your network.

C) How to Market on Social (Collaborative) Bookmarking SitesHere are a number of websites that specialize in social bookmarking. When you register with the service the service will collect and organize the sites that you choose to bookmark and allow you to share them with other others. The social concept allows each service to create content-specific directories of user-selected content; which states (theoretically) the content is of a high quality.

Del.icio.us: bought by Yahoo in 2005, Del.icio.us is the web’s leading bookmarking site.

StumbleUpon: in the past when my best content got ‘stumbled’ by users I found this community to offer the highest quality response in terms of traffic and buzz.

Yahoo! MyWeb: Yahoo’s huge following has made MyWeb a popular bookmarking property and a top property for promotion.

Backflip: started in 1999 (or possibly earlier) this site is the one of the granddaddies of bookmarking but it came on harsh times and was sold to passionate employees who maintain it now.
